TERMS AND CONDITIONS OF SERVICE

Welcome to Sculpt Pilates (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website (https://sculptpilates.com.au/), studio facilities, booking systems, and services. By accessing our site, booking a class, or purchasing a membership, you agree to comply with and be bound by these Terms.

1. Studio Rules & Code of Conduct

To ensure a safe, comfortable, and respectful environment for all clients and instructors, you agree to adhere to the following rules:

  • Punctuality: Please arrive 5–10 minutes before class start time. For safety reasons and to avoid disrupting class, late arrivals may not be permitted to enter once class has commenced.
  • Grip Socks: For hygiene and safety, approved non-slip grip socks must be worn during all reformer and mat Pilates classes.
  • Equipment Hygiene: Members are required to wipe down their reformer, mat, and any used props with the provided sanitiser after every session.
  • Personal Belongings: Personal items must be stored in the designated cubbies/lockers. Sculpt Pilates is not responsible for any lost, stolen, or damaged personal property.

2. Health, Safety & Medical Disclaimer

By participating in classes at Sculpt Pilates, you acknowledge and agree to the following health terms:

  • Physical Readiness: You warrant that you are physically fit and have no medical conditions, injuries, or physical limitations that would prevent your safe participation in exercise classes.
  • Medical Clearance: If you are pregnant, postpartum, recovering from surgery, or managing a chronic injury, you must consult a physician prior to attending classes and inform your instructor before class begins.
  • Assumption of Risk: Exercise and fitness activities carry inherent risks of injury. You voluntarily assume all risk of physical injury or harm associated with your participation in our classes or use of studio facilities.

3. Bookings, Cancellations & No-Show Policy

Class space is limited, and we operate a strict booking and cancellation policy to ensure fairness for all members:

  • Class Bookings: All classes must be booked and paid for in advance via our online booking system or app.
  • Cancellation Window: You must cancel your class booking at least 9 hours prior to the scheduled start time to receive a class credit refund.
  • Late Cancellations: Cancellations made within the 9-hour window will forfeit the class pass/credit.
  • No-Shows: If you fail to attend a booked class without cancelling, the class pass will be forfeited. Unlimited membership holders may incur a $10 Late Cancel / No-Show Fee charged to their default payment method.
  • Waitlists: If a class is full, you can join the waitlist. If a spot opens up within the cancellation window, you will automatically be moved into the class and notified via email/SMS.

4. Memberships, Class Packs & Payments

All financial transactions are processed securely in Australian Dollars (AUD):

  • Class Passes & Packs: Single passes and class packs are non-refundable, non-transferable, and subject to strict expiry dates from the date of purchase. Unused classes after the expiry date will be forfeited.
  • Direct Debit Memberships: Recurring weekly/fortnightly memberships are automatically debited from your nominated card. Failed direct debits may incur a transaction retry fee.
  • Membership Suspensions & Holds: Direct debit memberships can be paused for medical or travel reasons by providing written notice to info@sculptpilatesco.com at least 7 days prior to the billing date.
  • Cancellations: Membership cancellations require a written notice period (standard 14 days) prior to the next billing cycle.

5. Photography & Media Consent

From time to time, staff or designated photographers may take photos or short videos during classes for promotional and marketing purposes (including website and social media):

  • We will notify the class prior to recording or photography.
  • If you do not wish to be featured in marketing material, please inform the instructor or photographer prior to the start of class.

6. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, Sculpt Pilates, its directors, employees, contractors, and instructors shall not be liable for any direct, indirect, incidental, or consequential damages, loss, or injury arising from your use of our services, studio facilities, or website.

7. Intellectual Property

All content on our website, including logos, graphics, text, photos, and software, is the property of Sculpt Pilates or its content suppliers and is protected by Australian and international copyright laws. Unauthorised reproduction or distribution is prohibited.

8. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will be updated on this page with a revised “Last Updated” date. Continued use of our website or studio services constitutes acceptance of the updated Terms.
